(*)The lecture ‘Legislation for Chemists’ aims to provide students with a basic understanding of the international, European and Austrian legal system in general and the legal areas with which they will be confronted in their professional work as chemists. The basis for this is, on the one hand, an understanding of the functioning of provisions and, on the other hand, a brief journey through the history of environmental law. The principles of European environmental law in particular are also of key importance. Building on this, key practical problem areas of neighbouring law, product law and occupational safety law are discussed and practical cases are discussed and solved together. At the end of the course, students should be able to recognise legal problems in practice, particularly in these areas of law, and discuss them efficiently with lawyers.
Fertigkeiten Kenntnisse
(*)The contents of the course enable students to: • recognise the basic structures and essential problems o of neighbouring law, o of product law in the broadest sense and o of occupational safety law • assess the permissibility of immissions on neighbouring properties in the specific situation in practice in the area of neighbouring law • assess and observe the essential legal requirements for the construction, operation and closure of commercial operating facilities • to know the essential structures and the basic procedure of EIA procedures and to act in this area in a function in a company or as an expert and to communicate with the other parties involved in the procedure • to recognise (and avoid) the criminal law consequences of violations of environmental regulations • to recognise basic problems of (technical) occupational safety law and to act in accordance with the law within the company • to recognise basic problems of general product safety law, European and Austrian chemicals law and product safety law and to act in accordance with the law (*)• Structure of the international, European and Austrian legal system • Principles of environmental law • History of environmental law • Constitutional foundations of environmental law and in particular chemicals law • Fundamentals of neighbouring law • System of (private) environmental liability law • Fundamentals of industrial plant law • Fundamentals of the environmental impact assessment procedure • Fundamentals of environmental criminal law • Fundamentals of (technical) occupational safety law • Fundamentals of European and Austrian general product safety law • Fundamentals of chemicals law (in particular REACH Regulation, CLP Regulation, Austrian chemicals law) • Fundamentals of European and Austrian product liability law
