Learning Outcomes
Competences
Students can accompany administrative (criminal) proceedings up to the Administrative Courts and, together with professional party representatives, assess the (expediency of) appealing to the Courts of Public Law; they know the central fundamental economic rights and understand the functioning of the protection of fundamental rights.
Skills Knowledge
  • understand and explain fundamental economic rights and the functioning of the protection of fundamental rights (k2, k3)
  • describe the respective course of proceedings and recognize options for action in specific procedural scenarios (k2, k4)
  • work on and discuss practical examples of administrative procedural law at administrative authorities, Administrative Court proceedings at the Administrative Courts and proceedings before the Administrative Court and the Constitutional Court (in particular in the area of special administrative jurisdiction and in the area of general review of standards) (k2, k3)
  • essential legal bases for proceedings before the administrative authorities (in particular AVG), at the Administrative Courts (VwGVG) and the Courts of Public Law (VfGG, VwGG)
  • procedural issues relating to central areas of commercial administrative law (e.g. trade law, plant law, building and regional planning law)
  • fundamental rights of the economy (in particular freedom of acquisition, freedom of property, principle of equality, fundamental procedural rights) - sources of law, functioning and judicial enforcement
Criteria for evaluation (*)Lehrveranstaltungsprüfung. Die Beurteilung erfolgt auf Grundlage von Klausuren, Hausübungen, automatisierten Computer-Tests, mündlichen Prüfungen und/oder Mitarbeit in der Lehrveranstaltung.

Further information (*)KS Wirtschaftsgrundrechte und Rechtsdurchsetzung (2 ECTS) + Ergänzungsprüfung ODER AG Öffentliches Recht im wirtschaftlichen Kontext II (3 ECTS) gilt gemäß § 10 Abs 2 und 3 Curriculum Bachelor Wirtschaftsrecht 2023 als VU Verfahrensrecht (4 ECTS).
