Objectives Basic knowledge of International Commercial Arbitration both with a domestic and international focus.
Subject Presentation of the basics of international commercial arbitration (e.g. definition of arbitration, advantages and disadvantages of arbitration, arbitrability, arbitration agreement, arbitral awards, enforcement of arbitral awards, ad hoc and institutional arbitration). A special focus is given to arbitration in the USA; furthermore the major differences between state supported ad hoc arbitration and institutional rules are presented. The following topics are discussed in more detail: Arbitral Tribunal, Arbitration Clause, Arbitral Award, Arbitration Institutions, UNCITRAL Model Law, international arbitration, Alternative Dispute Resolution and arbitration case law (again with special focus to US law).
